According to the Clarkstown Police, officers responded to reports of a person lying in the roadway and found Rivera, who was riding an electric scooter. Unfortunately, he had sustained severe trauma and was pronounced dead at the scene.
A witness who remained at the scene provided crucial information to the police. The witness saw a white SUV traveling southbound on Route 303 in the right-hand lane. The SUV appeared to hit something in the roadway and continued driving in a southerly direction. The witness stopped and discovered Rivera in the roadway, immediately calling 911.

The Clarkstown Police Department’s accident Investigation Team arrived at the scene and conducted their investigation, resulting in the closure of that section of Route 303 for several hours. Meanwhile, the driver of a white Honda Pilot, identified as Patrick J. Sharkey III, came forward to report that he had hit someone on Route 303 earlier. Sharkey was subsequently arrested and charged with leaving the scene of an accident resulting in death, aggravated unlicensed operation, and circumventing an interlock device.
